These terms and conditions define the rules for using the FabMate website, available at fabmate.pl. Using the website implies acceptance of these terms and conditions.
2. Definitions
- Website — the FabMate web application available at fabmate.pl
- User — a natural or legal person using the Website
- Account — an individual user account created as a result of registration
- Organization — a company or entity to which the User is assigned
- Provider — FabMate
3. Registration and Account
Using the full functionality of the Website requires registration and creation of an account. The User agrees to provide true data during registration. The User is responsible for maintaining the confidentiality of the login credentials.
4. Scope of Services
The FabMate service enables:
- Creating production cost calculations
- Optimization of material nesting (sheets, profiles)
- Management of inquiries
- Maintaining a database of materials, operations, and contractors
- Management of the organization and team
5. Open Beta
The FabMate service is currently shared as an open beta. This means that all features are available free of charge. The Provider reserves the right to introduce fees in the future, of which Users will be informed with appropriate notice.
The User acknowledges that the Website in Beta version is software in the test phase, which entails an increased risk of technical errors, interruptions in operation or loss of data. The User uses the Beta version at their own risk, having full awareness of its imperfections.
6. User Obligations
The User agrees to:
- Use the Website as intended
- Not take actions that could disrupt the functioning of the Website
- Not share login credentials with third parties
- Comply with applicable law
7. Liability and Exclusions
The Provider makes every effort to ensure that the Service works properly and without interruptions. However, it does not guarantee the continuous and uninterrupted availability of the Service.
The Provider provides the Service "as is" and "as available", without any guarantees, express or implied, including guarantees of fitness for a particular purpose.
The Provider is not responsible for:
- Errors in cost calculations, valuations, and calculations generated by the Service
- Incorrect or suboptimal material layouts (nesting of sheets, profiles, and other materials)
- Material losses resulting from the use of layouts generated by the Service
- Incorrect prices, operation costs, or material costs resulting from Service calculations
- Production and business decisions made on the basis of data from the Service
- Financial or material losses resulting from interruptions in the operation of the Service or loss of data
All calculations, nestings, and valuations generated by the Service are for information and illustrative purposes only. The User agrees to independently verify all results before applying them in the production process. The User uses the Service at their own risk.
8. Intellectual Property
All intellectual property rights to the Service, including the source code, graphics, logo, and content, belong to the Provider. The User does not acquire any intellectual property rights to the Service by using it.
9. Personal Data Protection
The rules for processing personal data are defined in the Privacy Policy, which is an integral part of these terms and conditions. Privacy Policy, constituting an integral part of these terms and conditions.
10. Changes to the Terms
The Provider reserves the right to change these terms and conditions. Users will be informed of any changes via the Service. Continued use of the Service after the changes are introduced implies acceptance of them.
